1. About these terms
These terms are intended to govern use of the Your Gift Is A Song™ website and personalised song service operated by the applicable HiGoTec business entity identified at checkout.
The final legal entity, business address, governing law and effective date must be inserted before launch. If a separate order summary conflicts with general marketing copy, the confirmed order information and applicable law take priority.
2. Your account and information
Provide accurate contact information and protect your Mission Control sign-in details. Do not use another person’s account without permission.
You are responsible for having a lawful basis to share names, stories, photographs, recordings or other personal information. Avoid submitting unnecessary sensitive information, secrets or material another person would reasonably expect to remain private.
3. The personalised service
The service uses the information you provide to prepare original, personalised song materials. The selected package, price, included files, revision allowance and any delivery target must be displayed before payment.
Creative judgement is part of a personalised service. A preference for different wording or style is handled through the revision rights in the selected package rather than by promising an exact artistic outcome.
4. Content and acceptable use
Do not submit unlawful, threatening, hateful, defamatory, deceptive or rights-infringing material. Do not ask for the imitation of a living artist’s voice or a copy of protected lyrics, melody or recording.
You retain rights in material you provide. You grant the permissions reasonably required to process it, create the ordered work, support your project and meet legal obligations. Final licence wording must state the permitted personal or commercial use for each package.
5. Prices, payment and consumer rights
Prices are shown in the selected supported currency. The checkout must show the full payable amount, taxes where applicable and any unavoidable fee before confirmation.
Nothing in these terms excludes a guarantee, remedy or other right that cannot lawfully be excluded, including rights under the Australian Consumer Law where it applies.
6. Changes, suspension and contact
The service may be paused when needed for security, maintenance, misuse prevention or circumstances outside reasonable control. Material changes to accepted order terms should not be applied retrospectively without a lawful basis.
